Buffalo Police Department Commissioner Joseph Gramaglia said on Sunday that the 18-year-old suspect in the Tops supermarket shooting Saturday that left 10 people dead and injured three others in Buffalo, N.Y., Payton Gendron, had been previously picked up by New York State Police and given a mental health evaluation.

"The individual was brought in for a mental health evaluation. He was evaluated and then he was released. As far as, when we say 'on-the-radar' - there was nothing picked up on the state police intelligence, nothing picked up on the FBI intelligence," Gramaglia said. "Nobody called in, nobody called in any complaints."

Out of the 13 victims, 11 were Black and two were white while the shooter is white, police said on Saturday.

"This is an absolute racist hate crime, it will be prosecuted as a hate crime," Gramaglia said Sunday.

"This is someone who has hate in their heart, soul and mind and there is no mistake that this is the direction this is going in."
