Former federal prosecutor Renato Mariotti said Thursday that it’s unlikely that former President Donald Trump will be sentenced to prison after being found guilty on 34 counts of falsifying business records.

“I would be very surprised if that is the case, given the sort of punishments that have been doled out for the same charge in Manhattan in the past,” Mariotti said.

The unprecedented verdict made Trump the first former president in U.S. history to be convicted on criminal charges. The trial focused on payments made by Trump’s former lawyer Michael Cohen to cover up stories about the then-candidate that could have been politically damaging during the 2016 presidential election.

Judge Juan Merchan set July 11 as Trump’s sentencing date.
