Parliamentary privilege? How Ford is refusing to testify on Emergencies Act

After ducking reporters and the opposition, Ontario Premier Doug Ford has finally broken his silence on why he has been refusing to testify at the public hearings into the use of the Emergencies Act. Ford appeared in the legislature on Wednesday, for the first time since he was summoned by the commission.

As the commission of inquiry tries to find out whether the Emergencies Act was necessary to end the Ottawa occupation, the question of Ford's response has been lingering. The commission issued a subpoena to compel Ford to testify on Nov. 10, but Ford has maintained that the issue wasn't for him to resolve.

On Tuesday, the province filed a legal motion, claiming that the premier had parliamentary privilege which prevents him from testifying. But the use of it in this context has raised eyebrows, and the government is now looking to make its case in front of a judge on Nov. 1.
