Liberals move to axe mandatory minimums for all drug, some gun offences | FULL

Canadian Justice Minister David Lametti announced Tuesday that the government had tabled a bill that, if passed, would repeal mandatory minimum penalties for all drug and certain firearm offences.

Under the new law, if it receives Royal Assent, the Criminal Code would be amended to allow a judge to exercise discretion in imposing sentences that relate to the facts of the case. The judge could also be able to impose conditional sentences like house arrest or counselling instead of incarceration for those considered not to pose a risk to public safety.

It would also require police and prosecutors to consider alternative measures for cases of simple drug possession, such as treatment instead of prosecution.

Lametti also defended the bill when asked why the government was not going further, saying the bill was an "important step" to target offences that lead to overrepresentation of Black, Indigenous and other racialized Canadians in the criminal justice system.
