Adnan Syed, a man who was the subject of the hit podcast "Serial" and was convicted for the 1999 murder of high school student Hae Min Lee, left prison on Monday after a Baltimore judge ordered his release and overturned his conviction after more than 20 years in prison.
Prosecutors made the request for the conviction to be vacated after they said new evidence had been uncovered. There were reportedly gasps and applause in the crowded courtroom as the judge announced her decision. Circuit Court Judge Melissa Phinn ruled the state violated its legal obligation to share evidence that could have bolstered Syed's defence. She ordered Syed to be placed on home detention with GPS location monitoring.
"At this stage, a trial has been set in for a new trial date because we're not yet declaring Adnan Syed is innocent," state's attorney for Baltimore, Marilyn Mosby, said. "But we are declaring that in the interest of fairness and justice, he is entitled to a new trial."
Steven Kelly, a lawyer representing Lee's family called the conduct of prosecutors "inexcusable", saying the family was denied their right to participate in the legal process and would be looking into their right to appeal.
