Ukraine faces legal setback as World Court dismisses multiple of Russia's UN treaty violation cases

The International Court of Justice (ICJ) dismissed much of Ukraine's 2017 case against Russia on violating United Nations (UN) treaties on Wednesday — including allegations that they funded pro-Russian separatists in Ukraine who shot down Malaysia Airlines flight MH17 in 2014.

Above eastern Ukraine on July 17, 2014, a Boeing 777 flying from Amsterdam to Kuala Lumpur was shot down by a Buk missile, killing all 283 passengers and 15 staff. The surface-to-air projectile was moved into eastern Ukraine by Russia.

Though the World Court judges found Russia had violated elements of an anti-terrorism treaty with its financial involvement, they declined to rule on Ukraine’s allegations that Moscow was responsible for the act of terrorism. The ICJ panel said that violations of funding terrorism only applied to monetary and financial support, but not to supplying weapons or training alleged by Ukraine.

Additionally, Russia was found to have breached an anti-discrimination treaty by failing to support Ukrainian language education in Crimea after taking over in 2014. Ukraine’s claim that Russia was trying to erase the culture of ethnic Taters, however, was dismissed.
