The Kyle Rittenhouse trial was in jeopardy on Wednesday after the teen's defence lawyers asked for a mistrial over what they argued were out-of-bounds questions asked of him by the chief prosecutor. These questions included the 18-year-old's silence after his arrest, which also prompted the judge to issue a sharp rebuke of the prosecutor.

Judge Bruce Schroeder said he would consider the request, but allowed cross-examination by prosecutor Thomas Binger to continue into the evening.

During Rittenhouse's testimony, he broke down and at one point appeared to hyperventilate as he described being under attack when he killed two men and wounded a third with his rifle. The shootings occurred during a night of protests in Kenosha, Wis. on Aug. 25, 2020, as people demonstrated in response to the shooting of Jacob Blake.

As Sean Previl reports, the defence is set to continue questioning its witnesses and experts Thursday with closing arguments expected as soon as Monday.
