Jordan Neely death: Former marine Daniel Penny charged with 2nd-degree manslaughter

Twenty-four-year-old Daniel Penny, a former U.S. Marine who killed a homeless man by putting him in a chokehold on the New York City subway, was taken into custody at a police precinct Friday and was arraigned on a second-degree manslaughter charge.

“We were overjoyed to learn yesterday that… the arrest would happen today. And I would say: keep going. Keep going,” said Lennon Edwards, attorney for the Neely family.

“Before we talk about charges; before we talk about the person who took his life, we need to know who [Jordan] was and who he had with him. That’s who Jordan Neely was,” attorney Donte Mills said. “He was one of us.”

A viral video appeared to show the former Marine putting 30-year-old Jordan Neely in a chokehold on May 1 while they rode on the F train in Manhattan, and has been circulating widely since. According to the medical examiner, Neely died from compression of the neck. Penny's lawyers said he did not mean to kill him.
