DNA: मुख्यमंत्री अरविंद केजरीवाल की गिरफ्तारी के बाद से दिल्ली में राष्ट्रपति शासन को लेकर भी चर्चाएं होने लगी हैं। सवाल ये है कि ऐसा कौन सी परिस्थितियों में होगा। जानकारों के मुताबिक अगर अरविंद केजरीवाल जेल से सरकार चलाने की जिद पर अड़े रहते हैं, तो दिल्ली को चलाने के लिए तीसरा विकल्प राष्ट्रपति शासन हो सकता है। Representation Of People's Act 1951 में किसी जनप्रतिनिधि को अयोग्य ठहराने का प्रावधान है, लेकिन मुख्यमंत्री केजरीवाल को पद से हटाने के लिए उनका दोषी साबित होना जरूरी है। दूसरी तरफ अगर अरविंद केजरीवाल इस्तीफा ना देने पर अड़े रहते हैं तो उप-राज्यपाल चाहें तो दिल्ली में राष्ट्रपति शासन लगाने की कार्यवाही शुरू कर सकते हैं। दिल्ली में राष्ट्रपति शासन लागू किए जाने के लिए दो प्रमुख बातों को आधार बनाया जा सकता है. पहली वजह ये कि जब कोई सरकार संविधान के मुताबिक सरकार चलाने में सक्षम ना हो तो किसी भी केंद्रशासित और पूर्ण राज्य में राष्ट्रपति शासन लगाया जा सकता है। दूसरी वजह, जब राज्य सरकार केंद्र सरकार के निर्देशों को लागू करने में पूरी तरह से नाकाम साबित हुई हो, तब भी ऐसा कदम उठाया जा सकता है। तब राज्य की सभी शक्तियां राष्ट्रपति के पास चली जाती हैं।
