Colorado Springs club shooting: Previous case against alleged shooter dismissed in 2021 | FULL

Michael Allen, District Attorney for Colorado’s fourth judicial district, said the previous case against the alleged suspect in a shooting at a Colorado Springs LGBTQ nightclub was dismissed because the victims in that case couldn’t be served with a subpoena to appear in court.

Allen said after the victims, who were the grandparents and mother of the accused, failed to co-operate with the judge who had granted a continuance to allow prosecutors more time to locate them. However, when those attempts were unsuccessful, the judge ultimately dismissed the case.

Additionally, Allen said the weapons seized during the 2021 case were never returned.

He said the felony charges laid in that case would have been more successful than an extreme risk protection order at preventing future violence because the “lawful transfer” of firearms was prohibited for more than a year while the case was pending.

He added that an extreme risk protection order obtained under Colorado’s red flag laws “would not have prevented” the tragic shooting in November.
