U.S. Attorney General Merrick Garland was in Buffalo, N.Y., on Wednesday where he toured the site of a vigil for victims of the Tops supermarket mass shooting that left 10 people dead.

He also met with family members of those who were killed and survivors of the attack. Afterwards, Garland spoke about the Department of Justice (DOJ) charging the subject with federal hate crimes in which he could face the death penalty.

"The complaint we have filed today charges Payton Gendron with 10 counts of committing a hate crime resulting in death. Three counts of committing a hate crime with an intent to kill. Ten counts of using a firearm to commit murder during and in relation to a crime of violence. And three counts of using and discharging a firearm during and in relation to a crime of violence," Garland said.

Asked about reports that the accused may have told others through an online chat room that he was going to commit the crime before doing so, Garland said the "investigation is ongoing and includes all aspects."
