Forty-nine years ago, the Supreme Court decided Roe v. Wade and held that the Constitution protects a woman’s right to have an abortion. The Biden-Harris Administration is fighting to protect that constitutional right, and has taken action to defend women’s access to reproductive healthcare.
The President and Vice President strongly denounced the Texas law, SB 8, which bans abortions after six weeks of pregnancy, as a blatant violation of women’s constitutional rights, and launched an immediate response, directing the Gender Policy Council and White House Counsel to lead a whole-of-government effort to protect women’s rights in Texas and across this country. The Department of Justice brought a lawsuit challenging the constitutionality of the Texas law, and the Department of Health and Human Services expanded Title X funding to Texas healthcare providers.
The President and Vice President have committed to protecting and defending the long-recognized, constitutional right to safe and legal abortion by working with Congress to codify Roe in federal statute. The Administration continues to call for passage of the Women’s Health Protection Act.
