Delhi's IAS officers will now be under the control of Delhi's Kejriwal government. The Delhi government, which has been fighting a legal battle with the central government for a long time on the transfer-posting of officers working under it, got a major relief from the Supreme Court on Thursday (May 11). A five-judge constitution bench has unanimously agreed that only the elected government of Delhi should get control over the officers. The Supreme Court has said that the situation in Delhi is different from other union territories. Under Article 239AA of the Constitution, there is a Legislative Assembly, which has been empowered to make laws on most issues. The Legislative Assembly of Delhi cannot enact laws only on subjects related to police, law and order and land. Similarly, except these three subjects, the Delhi government also has executive power in other matters. The matter of services also comes under the jurisdiction of the Delhi government.

दिल्ली के आईएएस अधिकारियों पर अब दिल्ली की केजरीवाल सरकार का नियंत्रण होगा. अपने तहत काम करने वाले अधिकारियों के ट्रांसफर-पोस्टिंग पर लंबे समय से केंद्र सरकार के साथ कानूनी लड़ाई लड़ रही दिल्ली सरकार को सुप्रीम कोर्ट से गुरुवार (11 मई) को बड़ी राहत मिली. पांच जजों की संविधान पीठ ने एकमत से यह माना है कि दिल्ली की चुनी हुई सरकार को ही अधिकारियों पर नियंत्रण मिलना चाहिए. सुप्रीम कोर्ट ने कहा है कि दिल्ली की स्थिति दूसरे केंद्र शासित क्षेत्रों से अलग है. संविधान के अनुच्छेद 239AA के तहत यहां एक विधानसभा है, जिसे अधिकतर मसलों पर कानून बनाने का अधिकार दिया गया है. दिल्ली की विधानसभा सिर्फ पुलिस, कानून व्यवस्था और भूमि से जुड़े विषय पर कानून नहीं बना सकती. उसी तरह दिल्ली सरकार को भी इन तीन विषयों को छोड़ कर बाकी मामलों में कार्यकारी शक्ति हासिल है. सर्विसेज का मामला भी दिल्ली सरकार के अधिकार क्षेत्र में आता है.
