The Islamabad High Court (IHC) took action on Tuesday to suspend the sentence imposed on the PTI chairman in relation to the Toshakhana case.
A division bench composed of two members at the IHC delivered a decision that had been held in reserve since Monday. The court also directed authorities to release the former prime minister from incarceration. The concise verdict was announced by the Chief Justice of the Islamabad High Court, with the detailed judgment anticipated to follow shortly.
Earlier on Monday, the IHC had kept its ruling pending on the appeal made by the PTI chairman against the sentence handed down in the Toshakhana criminal case. The appeal was heard by a division bench headed by IHC Chief Justice Aamir Farooq and Justice Tariq Mehmood Jahangiri. The election commission's attorney, Amjad Pervaiz, presented his arguments during the proceedings on that day, having missed the prior hearing due to health concerns.
The chief justice had instructed Pervaiz to ensure his attendance at the subsequent hearing, warning that if he were absent, a judgment would be rendered based on the available records. Upon Pervaiz's completion of arguments on behalf of the ECP, the court reserved its decision on the case, later announcing that the verdict would be disclosed at 11:00 AM on Tuesday.
Meanwhile, on August 26, a Federal Investigation Agency (FIA) team questioned the PTI chief regarding the US cipher case while he was in Attock Jail. The former prime minister was interrogated about the alleged disappearance of the cipher. The FIA's cybercrime team, led by Deputy Director Ayaz, conducted the inquiry.
During the interrogation, the suspect was queried for over an hour about the illicit utilization and vanishing of the cipher. An FIR had been registered against him, along with PTI Vice Chairman Shah Mahmood Qureshi and other party leaders, under the Official Secrets Act and the PPC for unauthorized employment and misplacement of the cipher.
At present, the PTI chief is serving a sentence in the Toshakhana criminal case at Attock Jail, which had been handed down by the Islamabad sessions court.
